TERMS & CONDITIONS OF SALE
Effective Date: 18 May 2026
These Terms & Conditions apply to all quotations, online purchases, orders, installations, services and supplies provided by Australian Warning Systems (“AWS”, “we”, “our” or “us”).
By purchasing goods or services from AWS, placing an order, accepting a quotation, creating an account, or using our website, the customer agrees to these Terms & Conditions.
These Terms & Conditions apply to all customers including individuals, sole traders, businesses, partnerships, companies, corporations, government departments, fleet operators, emergency services organisations and trade account holders (“Customer”).
AWS reserves the right to amend these Terms & Conditions at any time without prior notice.
1. DEFINITIONS
“Goods” means all products, parts, accessories, components, equipment, hardware, software and materials supplied by AWS.
“Services” means all installation, fitment, programming, design, consultation, repair, configuration, labour and related services supplied by AWS.
“Website” means the AWS website, online store, online payment systems and associated digital platforms.
“Order” means any purchase order, online order, quotation acceptance or instruction to supply goods or services.
2. CUSTOMER WARRANTY
The Customer warrants to AWS that they are authorised to enter into this agreement and have the legal capacity and authority to purchase goods and services from AWS.
Where the Customer is acting on behalf of a business, company, corporation, government department or other entity, the individual placing the order warrants that they are authorised to bind that entity to these Terms & Conditions.
The Customer further warrants that all information supplied to AWS is true, accurate and complete.
3. AUSTRALIAN CONSUMER LAW
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies which cannot lawfully be excluded under the Australian Consumer Law (“ACL”) or any other applicable legislation.
Customers may be entitled to certain statutory rights and remedies under the ACL, including consumer guarantees relating to acceptable quality, fitness for purpose and due care and skill.
Where permitted by law, AWS limits its liability for any breach of a non-excludable guarantee to:
- replacement of the goods;
- repair of the goods;
- payment of the cost of replacing or repairing the goods;
- re-supply of services; or
- payment of the cost of re-supplying services.
Nothing in these Terms affects any rights a consumer may have under the ACL for major failures.
4. PRICING
AWS reserves the right to change pricing, freight charges, specifications, product availability and product configurations without prior notice.
All orders will be invoiced at the net prices applicable at the time of shipment or service completion.
All prices are in Australian Dollars (AUD) and include GST unless otherwise stated.
AWS reserves the right to:
- correct pricing errors;
- correct typographical or website errors;
- cancel orders arising from technical issues or pricing mistakes;
- refuse supply where products become unavailable.
If an order is cancelled due to a pricing or system error, the Customer will receive a full refund of any amount paid.
Quotations are valid for thirty (30) days unless otherwise stated in writing.
5. ACCOUNT HOLDER PURCHASE POLICY
Customers with an existing AWS trading account are encouraged to contact the AWS sales team for tailored quotations and account-specific pricing.
Purchases made through the retail online store by account holders:
- may not qualify for account-specific pricing or discounts;
- may not be eligible for price adjustments, retroactive discounts or refunds relating to account pricing agreements;
- may be reviewed by AWS to ensure the order is placed through the appropriate sales channel.
AWS reserves the right to contact account holders regarding online purchases and adjust order processing procedures accordingly.
6. SALES POLICY
AWS products may also be distributed through authorised distributors, resellers and dealers.
Possession of an AWS price list or quotation does not oblige distributors or resellers to maintain identical pricing structures.
All resale pricing is determined independently by each reseller or distributor.
7. RESTRICTED PRODUCTS & ORDER REVIEW POLICY
The AWS website and online store are used by a diverse range of customers and supply vehicle warning and safety equipment to emergency services, government agencies, fleet operators, commercial businesses and retail customers.
To ensure public safety and compliance with Australian laws, road regulations and industry requirements, AWS reserves the right to review, approve, refuse, decline or cancel any order that may be considered:
- inappropriate;
- unlawful;
- misleading;
- unsafe;
- non-compliant;
- suspicious; or
- likely to pose a risk to the community.
As a responsible Australian manufacturer and supplier, AWS takes proactive steps to prevent restricted-use products from being supplied to unauthorised persons or used inconsistently with their intended purpose.
Exemptions may be considered on a case-by-case basis including:
- film and television productions;
- motorsport applications;
- exhibitions;
- display vehicles;
- trade shows;
- authorised training environments.
Supporting documentation may be required prior to approval.
8. RESTRICTED PRODUCT RANGE CATEGORIES
The following product categories may be subject to restrictions, verification requirements or approval prior to dispatch:
- red, blue and magenta LED warning lights;
- emergency sirens and audible warning systems;
- products referencing Police, Fire, Ambulance or Rescue Services;
- government and Emergency Services radio network equipment;
- restricted emergency vehicle accessories;
- law-enforcement-style lighting systems;
- emergency response vehicle identification products.
AWS reserves the right to restrict supply of any product at its sole discretion.
9. VERIFICATION & COMPLIANCE
Where applicable, Customers may be required to provide:
- proof of authorisation;
- business identification;
- ABN details;
- government credentials;
- intended-use information;
- supporting documentation;
- vehicle registration details.
Failure to provide requested information may result in:
- order delays;
- cancellation of orders;
- refusal of supply;
- refunds being issued less applicable processing fees where permitted by law.
The Customer is solely responsible for ensuring that all products purchased are installed and used in compliance with all applicable laws, regulations, vehicle standards and licensing requirements within their jurisdiction.
AWS accepts no responsibility or liability for unlawful, unauthorised or non-compliant use of products supplied.
If a product requires authorisation, licensing or permits for legal use, obtaining such approvals remains solely the responsibility of the Customer.
10. ORDERS & PAYMENT
Orders are not binding until accepted by AWS.
Payments for non-account purchases are required prior to release of goods or completion of services unless otherwise agreed in writing.
Accepted payment methods may include:
- EFT;
- Visa;
- Mastercard;
- approved online payment gateways.
Credit card surcharge fees may apply and will be disclosed at checkout or invoicing.
AWS reserves the right to:
- refuse or cancel any order;
- limit quantities purchased;
- hold orders for verification;
- request identification documentation;
- request company or ABN verification;
- refuse suspicious or potentially fraudulent transactions.
Refunds will only be processed back to the original payment method used for the purchase unless otherwise required by law.
Any terms contained within a Customer purchase order or procurement document which are inconsistent with these Terms & Conditions shall have no effect unless expressly agreed in writing by AWS.
The Customer acknowledges that they have not relied upon any representation, statement or promise not expressly contained within these Terms & Conditions.
11. TERMS
Where an approved credit account exists, payment must be made within thirty (30) days from the invoice date unless otherwise agreed in writing.
Official government purchase orders will be payable within the period agreed to by an authorised representative of AWS and as endorsed on the invoice.
Late payments may incur:
- interest charges;
- administration fees;
- legal costs;
- debt recovery costs.
AWS reserves the right to suspend supply to overdue accounts.
Ownership of goods remains with AWS until payment has been received in full.
AWS may register its security interest under the Personal Property Securities Act 2009 (Cth) (“PPSA”) and the Customer agrees to do all things necessary to facilitate such registration.
AWS reserves the right to recover unpaid goods where legally permitted.
12. ACCOUNT CLOSURE
Where an approved trade account has not made a purchase within six (6) months, AWS reserves the right to close the account without notice.
Closure of an account does not waive any outstanding debts or obligations owed to AWS.
13. FRAUD PREVENTION & CHARGEBACKS
AWS actively monitors transactions and orders for fraud prevention and risk management purposes.
AWS reserves the right to:
- verify customer identity;
- request photo identification;
- request proof of address;
- verify cardholder information;
- delay or cancel suspicious orders;
- refuse transactions considered high-risk.
The Customer acknowledges that AWS may retain records including:
- IP addresses;
- payment verification data;
- device and browser information;
- communications;
- order history;
- serial numbers;
- freight tracking data;
- delivery confirmations;
- photographic dispatch evidence;
- signature-on-delivery records.
False chargebacks, fraudulent disputes, intentionally misleading claims, false “item not received” claims or attempts to dishonestly obtain goods or refunds may result in:
- refusal of future service;
- debt recovery action;
- reporting to banks or payment providers;
- civil proceedings;
- referral to law enforcement authorities.
Courier delivery scans, photographic evidence, GPS delivery confirmation, authority-to-leave records and signed delivery records may be relied upon as evidence of successful delivery.
14. DELIVERY & FREIGHT TERMS
Risk in goods passes:
- for consumer purchases, upon delivery;
- for customer-arranged freight, upon collection or dispatch.
Orders exceeding AUD $1,000.00 net value may be shipped freight prepaid within mainland Australia at AWS discretion.
Orders below AUD $1,000.00 net value are FOB Hallam, Victoria unless otherwise agreed.
Where approved, Customers may nominate their own freight provider or freight account.
AWS may arrange freight on behalf of the Customer and freight charges will be shown separately on invoices where applicable.
AWS will use reasonable efforts to dispatch stocked orders within one (1) to three (3) business days of order confirmation, subject to:
- stock availability;
- payment clearance;
- verification requirements;
- operational capacity.
Express or overnight freight services may be available upon request and quoted separately.
Acceptance of third-party freight accounts is entirely at AWS discretion.
Customers must inspect all goods prior to installation or use. Installation or use of goods constitutes acceptance that the goods were supplied in acceptable condition unless prohibited under Australian Consumer Law.
15. DELIVERY TIMEFRAMES
Dispatch and delivery timeframes are estimates only and are not guaranteed.
Indicative dispatch timeframes:
- stocked items: typically dispatched within 1–3 business days;
- special or custom orders: timeframe advised at order confirmation;
- out-of-stock items: lead times subject to supplier availability.
AWS is not liable for delays caused by:
- freight carriers;
- supplier shortages;
- customs clearance;
- manufacturing delays;
- weather events;
- industrial disputes;
- cyber incidents;
- events outside reasonable control.
16. CLAIMS
Claims for shortages or incorrect products must be made within seven (7) days of receipt.
Claims relating to freight damage or transit loss must be reported immediately to both AWS and the freight provider.
Claims relating to installation services must be referred directly to AWS for assessment.
Where possible, installations completed by AWS should be returned to AWS for inspection and assessment.
Third-party labour or repair costs will not be covered unless authorised in writing by AWS prior to repair.
17. WARRANTY
Warranty applies only to the original purchaser and is not transferable.
Unless otherwise specified, products and services supplied by AWS are warranted against defective workmanship, materials or design for a period of twelve (12) months from the invoice date.
Warranty claims may require:
- proof of purchase;
- serial numbers;
- installation records;
- inspection or testing.
Warranty does not cover:
- incorrect installation;
- misuse or abuse;
- improper wiring;
- unauthorised modifications;
- cosmetic wear;
- accidental damage;
- water ingress;
- voltage spikes;
- third-party interference;
- failure to follow instructions.
AWS is not responsible for:
- labour costs;
- vehicle downtime;
- rental vehicles;
- towing;
- accommodation costs;
- loss of income;
- third-party expenses;
unless required by law.
18. WARRANTY RETURNS
Items returned under warranty are subject to inspection and testing by AWS or the manufacturer.
Repair, replacement, store credit or refund will be determined by AWS in accordance with Australian Consumer Law obligations.
Incorrect installation, negligence, misuse or unauthorised modifications may void warranty coverage.
Any costs associated with non-warranty faults may be charged to the Customer.
Goods returned for warranty assessment must be shipped freight prepaid to AWS unless otherwise agreed.
Approved warranty claims may be returned freight free at AWS discretion.
19. GOODS RETURNS
A “Goods Return Notice” or Return Authorisation must be obtained from AWS prior to returning any goods.
Returned goods must:
- be shipped freight prepaid;
- be received in saleable condition;
- include original packaging, accessories and documentation.
Repackaging or handling fees may apply where returned packaging is damaged or incomplete.
Replacement goods may be invoiced separately and credits issued after inspection of returned goods.
Goods held by the Customer for longer than six (6) months from invoice date will not be accepted for credit or exchange.
Custom-made, programmed, modified or special-order products including lightbars and roof mounting systems are non-returnable unless required under Australian Consumer Law.
Change-of-mind returns are not automatically accepted and may incur restocking fees.
20. LIABILITY
Nothing in these Terms excludes rights that cannot lawfully be excluded under the Australian Consumer Law.
To the maximum extent permitted by law, AWS excludes liability for:
- indirect loss;
- consequential loss;
- business interruption;
- loss of profits;
- loss of opportunity;
- loss of data;
- loss arising from misuse, incorrect installation or unlawful use.
AWS does not warrant that goods or services are suitable for any purpose other than the purpose for which they were specifically designed.
AWS shall not be liable where:
- goods are used outside intended applications;
- written instructions are not followed;
- products are modified or tampered with;
- products are used unlawfully or non-compliantly;
- third-party equipment causes incompatibility;
- aftermarket modifications affect vehicle systems;
- pre-existing faults exist within the vehicle or equipment.
The Customer acknowledges that aftermarket electrical accessories and modifications may affect manufacturer warranties, electronic systems or vehicle performance.
AWS accepts no responsibility for compatibility issues outside AWS control.
AWS’s total liability relating to any claim is limited to the amount paid for the relevant goods or services supplied.
21. VEHICLES / ITEMS LEFT AT CUSTOMER’S RISK
Vehicles, trailers, vessels, equipment or other items left with AWS for installation, repair or service are left entirely at the Customer’s risk.
AWS shall not be liable for:
- theft;
- fire;
- weather damage;
- accidental damage;
- loss of contents;
- events outside reasonable control;
unless directly caused by proven negligence of AWS.
Customers are responsible for maintaining appropriate insurance coverage for all vehicles and items left with AWS.
22. WEBSITE & CYBER SECURITY DISCLAIMER
AWS does not warrant that the Website will operate uninterrupted, error-free or free from viruses, malware or cyber vulnerabilities.
Customers use the Website at their own risk.
AWS is not responsible for outages, technical failures or third-party payment gateway interruptions outside its reasonable control.
23. PRIVACY
AWS may collect, store and use Customer information for:
- order processing;
- fraud prevention;
- payment verification;
- delivery services;
- customer support;
- legal compliance.
AWS may disclose information to:
- payment providers;
- freight companies;
- fraud prevention services;
- insurers;
- debt recovery providers;
- law enforcement authorities where legally required.
24. FORCE MAJEURE
AWS shall not be liable for failure or delay in performance caused by events outside its reasonable control including:
- natural disasters;
- freight disruptions;
- supplier shortages;
- cyber attacks;
- pandemics;
- industrial disputes;
- government actions.
25. BINDING AGREEMENT
The Customer acknowledges that they have read, understood and agreed to these Terms & Conditions upon purchasing goods or services from AWS.
These Terms & Conditions are binding upon the Customer and are not transferable to any third party unless agreed in writing by AWS.
26. GOVERNING LAW
These Terms & Conditions are governed by the laws of Victoria, Australia.
Any disputes arising from these Terms & Conditions shall be subject to the jurisdiction of the courts of Victoria, Australia.
